John Jay by Gilbert Stuart: Introduction

John Jay sits in a sweeping red and black robe, one hand resting on a book while his head turns towards the right of the picture. Gilbert Stuart painted this portrait in 1794, when Jay was the first chief justice of the United States and was leaving for another diplomatic mission to Britain. The National Gallery of Art’s canvas combines an individual likeness with an imposing presentation of learning and public authority. [1] [2]

The painting also has a more intimate history. Sarah Livingston Jay followed its slow progress while her husband was abroad, and her letters describe the pleasure of finally receiving his image. Formal costume, family attachment and the practical difficulties of completing a portrait all belong to its story. They become clearer when this canvas is distinguished from Stuart’s other portraits of the same sitter. [3]

Which portrait of John Jay?

This is the seated portrait in which Jay wears conspicuous red and black robes. Its broad format allows the face, both hands, book and folded costume to establish the sitter’s presence together. A column rises behind him, and drapery descends at the left. These elements give the setting a formal character without turning it into a precisely identified courtroom. [2]

The object’s identity matters because Stuart had already painted Jay in London. An earlier likeness, later completed by John Trumbull, now belongs to the National Portrait Gallery. Another London portrait belongs to the State Department’s collection. Their different clothing, poses and completion histories should remain attached to the particular pictures. A shared sitter does not make their stories interchangeable. [14] [15]

The NGA’s painting belongs to the New York phase of Stuart’s career. It is the portrait discussed by Ellen G. Miles in the 2004 catalogue as having been begun before Jay’s departure for Britain in May 1794. The current museum identifies the same canvas as 2009.132.1, a family gift completed in 2019. The older catalogue’s description of it as a loan reflects its status at that earlier date. [16] [10]

Those distinctions allow the image to be considered on its own terms. Here, a carefully established face meets the broad action of an academic gown. The relationship between likeness and costume is central both to the painting’s visual effect and to the documentary record of its making.

1

The head above the robes

The light head and white neckcloth rise above a much larger area of red and black fabric. The eyes and face turn towards the side where the raised hand holds the book.

Broad folds and pale edging

The robe’s large red folds are crossed by light edging and darker shadows. The passages describe a substantial garment without giving every fold an equally sharp contour.

The hand on the upright book

Bent fingers rest on the book’s upper edge, joining the sitter’s body to a vertical object at the right. The white cuff separates the light hand from the red sleeve.

The resting hand

The other hand lies low across the lap, close to the dark cloth. Its calmer position balances the more conspicuous gesture at the book.

Face, pose and the red academic robe

Jay’s face is relatively still. The high forehead, long nose and clearly defined chin establish a firm profile within the three-quarter turn. Pale hair curls beside the ears and gathers behind the head. The eyes look beyond the viewer rather than offering a direct encounter. Warm colour in the cheeks gives life to a face whose outline remains restrained and precise. [2]

Around it, the robe creates a much more expansive movement. Red fabric spreads across the sleeve and chest, interrupted by large dark areas and narrow pale edging. Bright strokes catch projecting folds, while deeper tones make the cloth turn and gather. The breadth of this handling contrasts with the smaller decisions that define the eyes and mouth. The picture gains energy from the difference between the settled head and the flowing costume.

The robe is associated with the honorary doctor of laws degree Harvard awarded Jay in 1790. It brings academic distinction into his presentation as chief justice. Calling it simply a standard Supreme Court uniform would lose that particular association. The costume connects office, education and the sitter’s own honours rather than documenting what every justice wore. [2]

The hands give the figure two points of rest. One lies in the lap, where dark fabric gathers around it. The other reaches the upright book at the side. Its fingers curve over the top, connecting the sitter with a substantial object whose pale page edge also balances the white at his neck. The book conveys learned activity within the portrait, although its appearance does not establish a particular title. [2]

Background colour supports these relationships. The muted curtain repeats warmer tones more quietly than the robe, and the pale architectural setting leaves the head clearly visible. Stuart’s style and technique often depends on such differences in emphasis. The surrounding objects and broad areas of paint contribute to the likeness without demanding the same degree of finish as the face.

A commission in the New York years

Jay was an important contact when Stuart returned from Ireland to New York in 1793. In a later recollection recorded by Henry Pickering, the painter remembered seeking out someone he already knew from London. Miles uses that account to explain a relationship that supplied friendship, patronage and access to other influential sitters. It is a retrospective recollection, rather than a diary entry written on Stuart’s arrival. [17]

The portrait began before Jay left for Britain in May 1794, but it was still with the painter during the following months. Sarah’s letters kept her husband informed. In the August account quoted by Miles, she reported that Stuart had resumed work and that a nephew had been sitting in the robe. The catalogue suggests Peter Jay Munro as the likely nephew. The head and the costume could therefore be developed through different encounters. [16]

Her report, “it is now nearly done,” conveys both approval and impatience. She recognized the likeness and wanted it for herself, yet near-completion did not mean immediate delivery. The August passage reaches us through the catalogue’s discussion of earlier published transcriptions; its note explains that the original letter had not been located by the editors of the Jay Papers. [16]

The same letter introduces a potential audience beyond the family. Sarah reported that citizens had approached Stuart about allowing a New York engraver to copy the likeness, and that she had given her consent. The portrait could therefore be imagined both as a presence at home and as an image circulating more widely. Her agreement records an intention, rather than establishing that the proposed print was published. It also shows her taking an active part in decisions about the portrait while Jay was abroad, alongside her persistent efforts to have the painting delivered. [16]

Further requests followed. Miles traces Sarah’s continuing difficulty in obtaining the painting through the autumn correspondence, then records its arrival on 15 November. By early December she described it hanging in the dining room. That domestic destination places the formal image within a family’s daily surroundings: a public man’s portrait also helped sustain a private relationship during separation. [3]

Delivery did not settle every question of finish. In 1808, Peter Augustus Jay praised the likeness but complained about the drapery and wished another painter could complete it. His words preserve a later family response to the same object. They do not, by themselves, establish that a second artist actually repainted the robes. Miles treats the possibility of incompletion as a question supported by both the letter and the unevenly worked costume. [18]

Diplomacy, law and public character

Jay’s career explains the breadth of the identity presented here. He had helped negotiate the peace with Britain ending the Revolutionary War, served as secretary for foreign affairs and contributed to The Federalist alongside Alexander Hamilton and James Madison. His chief justiceship was one part of a public life that also included diplomacy and, subsequently, the governorship of New York. The National Archives’ account of his papers places these roles together. [19]

In 1794, diplomacy again drew him away from home. The negotiations that produced the Jay Treaty addressed unresolved disputes with Britain over matters including commerce and security. The portrait was begun before his departure, so its making overlapped with the separation described in Sarah’s letters. The painting can be placed within that treaty year without being treated as a record of the negotiations themselves. [20]

The costume and setting make public standing visible in a different way. Academic distinction is worn on the body; the book is brought within reach of the hand; the column supplies a substantial architectural presence. These are elements of an arranged portrait. Their combined effect is to give the sitter gravity and scale while the particular face keeps that presentation attached to an individual. [2]

Such a construction does not require the book to be The Federalist , the room to be a courtroom or the turned head to show a response to a particular political event. The more secure connection lies between Jay’s documented standing and the formal means Stuart used to portray him. The picture presents authority through an intelligible combination of likeness, gesture, honours and setting.

An image with several histories

The earlier portrait now at the National Portrait Gallery makes a useful comparison. Begun by Stuart in 1784 and completed by Trumbull by 1818, it shows Jay in a brown coat and pale waistcoat, seated beside books and papers. The museum credits both painters. This is NPG.74.46, a different canvas from the red-robed NGA portrait of 1794. [15]

Its completion history is unusually complicated. Miles recounts Stuart’s earlier London commissions, the portraits left unfinished and their recovery by Trumbull after they had been pledged. An account by Horace Holley, who saw a painting at Trumbull’s home in 1818, assigns the head to Stuart and the remainder to Trumbull. The evidence helps explain the shared authorship of the NPG portrait, but does not make 1818 its exact year of completion. [14]

The visual comparison is also revealing. Both pictures give Jay a seated setting with books, fabric and substantial furniture. In the NPG work, the bright waistcoat stands within a brown coat, and a folded sheet extends from one hand. In the NGA canvas, the academic robe expands across much of the figure, and the hand on the book provides a different focus. The same sitter is presented through distinct arrangements, each with its own history of work on the canvas.

The State Department’s London portrait forms another branch. Miles discusses the evidence for Trumbull’s possible involvement there with greater caution, noting the importance of Holley’s account. That portrait also circulated through Cornelius Tiebout’s 1795 engraving. A print after an earlier likeness should not be assumed to reproduce the NGA painting simply because it bears Jay’s name. [21]

These distinctions clarify the relationship between Stuart and John Trumbull . Collaboration and later completion are matters of particular objects and documented circumstances. They are different from the proposal, voiced by Jay’s son in 1808, that someone might improve the drapery of the red-robed portrait. An intended intervention and an established joint authorship are different kinds of history.

The painting and its collection history

The NGA records that Jay commissioned the portrait in 1794 and that it descended in his family. A partial and promised gift was made in 2009, with the gift completed in 2019. The museum also records a long loan from 1951 to 2009. These dates explain how a work could be associated with a public collection for decades before the transfer of ownership was complete. [10]

The painting’s family history gives Sarah’s letters a lasting significance. They describe the image as something wanted, awaited and displayed, rather than simply an official likeness produced for a civic institution. The grand presentation and the domestic attachment were compatible: the book, robes and column could sustain Jay’s public identity while his face brought a familiar person into the household. [3]

Jay also helped Stuart reach a wider circle of American patrons. His introduction to Washington contributed to the opportunities behind the later George Washington portraits . The relationship did not depend on perfectly smooth transactions over Jay’s own pictures. Miles’s account keeps his support for the painter alongside the family’s repeated frustrations about delivery and finish. [22]

Returning to the canvas brings those histories into a concentrated encounter. The face offers restraint; the robe supplies movement and colour; the hands connect the body with lap and book. The portrait’s force comes from making those different elements work together. It presents an influential public figure through an image that remained, for generations, a family possession.

Frequently Asked Questions

Which John Jay portrait is this?

It is the 1794 red-robed portrait at the National Gallery of Art, accession 2009.132.1. It differs from the earlier London portraits and the NPG work completed by Trumbull. [1] [14]

Why does Jay wear red and black robes?

The costume is associated with Harvard’s honorary doctor of laws degree, awarded to him in 1790. It connects academic distinction with his public identity as chief justice. [2]

Did Jay sit for the whole painting?

The catalogue places the head sittings before his departure for Britain in May 1794. Sarah’s later letter reports a nephew posing in the robe, suggesting that the costume was developed separately. [16]

Did Trumbull complete this canvas?

The NGA attributes this painting to Stuart. The NPG’s earlier portrait, NPG.74.46, is a separate work credited to both Stuart and Trumbull. A family wish to have the NGA painting’s drapery completed is not proof that such work occurred. [1] [18] [15]

When did it enter the National Gallery of Art?

It was lent from 1951 to 2009. The family made a partial and promised gift in 2009, completed in 2019. [10]
